DO’s and DON’Ts once you are charged with DUI:

DO’s

  • DO hire an attorney to represent you on your DUI.
  • DO inform your attorney of any witnesses who may be able to help you.
  • DO gather medical records from your physician that diagnose and treat any physical problems you may have.
  • DO memorialize your version of your DUI or DWI arrest while it is fresh in your mind, to share with your attorney only.
  • DO photograph the area of your motor vehicle stop and field tests as soon as possible.
  • DO try to be patient and understand the court process moves one step at a time.

DON’Ts

  • DON’T speak to anyone other than your attorney about the details of your DUI stop and arrest.
  • DON’T reach out to the police officer or the prosecutor in your DUI case.
  • DON’T write a letter to the judge in your DUI or DWI case.
  • DON’T appear in court without an DUI or DWI attorney
  • DON’T violate any conditions of your bail.



How to fight a DUI:

-Police had no reasonable suspicion to stop your vehicle.
-They cannot prove you were operating your vehicle.
-Officer had no right to ask you to perform the field sobriety tests.
-Not certified to perform field sobriety tests.
-They administered field sobriety tests improperly.
-Administered field sobriety tests under improper conditions.
-No probable cause to arrest you.

-Officer did not properly read you your rights.
-They were not certified to administer a breath test.
-They did not properly observe you prior to breath testing.
-Police did not read the proper form prior to breath or blood testing.
-They did not remove all cell phones and electronic devices from the DUI or DWI testing area.
-Officer did not properly administer the breath test.
-Breath testing instrument was not properly calibrated and/or certified.

-Breath testing instrument was not functioning properly at the time of your DUI or DWI test.
-Phlebotomist drawing blood was not properly certified.
-Phlebotomist did not draw the blood properly.
-Blood or urine sample was not properly analyzed.
-Drug Recognition officer was not properly certified.
-Drug Recognition Evaluation was not properly conducted.
